1. About these terms
This website, sarahnewyork.shop, is operated by Sarahnewyork India ("we", "us", "our"), Dharapat, Bankura, 101, Bishnupur, West Bengal 722122, India. By browsing the website or placing an order, you agree to these Terms of Service together with our Privacy policy, Shipping policy and Refund policy. If you do not agree, please do not use the website.
2. Eligibility
You must be at least 18 years old, or use the website under the supervision of a parent or guardian, and be able to enter into a binding contract under Indian law.
3. Products and information
- We try to describe and photograph every product accurately. Colours may look slightly different depending on your screen, and some product images are styled or illustrative.
- Our wellness, posture, sleep, beauty and nutrition products are for general wellbeing. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. If you are pregnant, breastfeeding, taking medication or have a medical condition, consult your doctor before use, and always follow the instructions on the packaging.
4. Prices and payment
- All prices are in Indian Rupees (₹) and include applicable taxes (GST). Delivery is free on all orders.
- The price you pay is the price shown at checkout when you place your order. If a product is listed at an obviously wrong price because of an error, we may cancel the order and refund any payment in full.
- Payments are processed securely by our payment partners. We do not store your card details. Cash on delivery is available on eligible orders.
5. Orders
Your order is an offer to buy. We accept it when we dispatch the goods. We may decline or cancel an order, for example if an item is out of stock, the delivery address is not serviceable or we suspect fraud. If we cancel an order you have paid for, we refund you in full.
6. Delivery, returns and refunds
Delivery is covered by our Shipping policy. Returns, exchanges, cancellations and refunds are covered by our Refund policy, which gives you 7 days from delivery to return eligible items with free pickup. Nothing in these terms limits your rights under the Consumer Protection Act, 2019.
7. Your account
You are responsible for keeping your account details secure and for activity under your account. Please tell us straight away if you think your account has been misused.
8. Acceptable use
You agree not to misuse the website, including by attempting to gain unauthorised access, interfering with its operation, posting unlawful or misleading content, or buying products for unauthorised resale.
9. Intellectual property
The website's content, including text, images, logos and design, belongs to us or our licensors and may not be copied or used without our written permission.
10. Third-party links and services
The website may link to or use third-party services such as payment gateways and courier tracking. Their own terms and policies apply, and we are not responsible for their content or practices.
11. Liability
To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing in these terms excludes liability that cannot be excluded under Indian law.
12. Governing law
These terms are governed by the laws of India. Any dispute will be subject to the jurisdiction of the courts of West Bengal, India, without affecting your right to approach a consumer commission under the Consumer Protection Act, 2019.
13. Changes to these terms
We may update these terms from time to time. The version on this page at the time you place an order applies to that order.
14. Grievance redressal and contact
In line with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, you can raise any complaint with our Grievance Officer. We acknowledge complaints within 48 hours and aim to resolve them within one month.
